Employers have a general duty (under section 2 of the Health and Safety at Work etc Act 1974) to reasonably ensure the health, safety and welfare of their employees within a working environment. People who are in control of non-domestic premises have an obligation (under section 4 of the Act) towards people who are not their employees but use their premises.

Such maintenance is required when concerning mechanical ventilation systems, equipment and devices which would cause risks to health, safety or welfare if a fault occurred.
